Arkansas Protection from Secondhand Smoke For Children Act Act 811 of 2011/ SB 1004 amends Act 13 of 2006 / HB 1046
Statute Number: ACA § 20-27-1901- 1904 Section 1. Arkansas Code § 20-27-1903 is amended to read as follows: 20-27-1903. Tobacco use — Prohibitions. Smoking is prohibited in any motor vehicle in which a child who is less than (14) years of age is a passenger.
Definition: A motor vehicle means any vehicle which is required by federal or state law or regulation to be equipped with a passenger restraint system. Except a school bus, church bus and other public conveyance Prohibitions on Tobacco Use Effective July 27, 2011, smoking will be prohibited in all motor vehicles where a child who is less than 14 years of age is a passenger. Penalties 1.Violation of this Act = violation and upon conviction shall be punished by a fine not to exceed $25.00 2.If guilty and the person pleads guilty, nolo contender (no contest) or forfeits bond for violation of this chapter will not have to pay court costs, or other costs or fees. 3.Any first offender that proves they have entered a smoking cessation program may have his or her fine eliminated.
*Breaking this law is considered a primary offense, law enforcement officers have the right to pull you over/stop you for suspected non-compliance.
